(EMAILWIRE.COM, April 29, 2011 ) New York, NY -- Koenigsberg & Associates, the attorneys for Doris Walker, a customer who was trampled and severely injured in the Wal-Mart Black Friday incident of November 28, 2008 at the Wal-Mart store at Green Acres Shopping Center in Valley Stream, New York, announced today that a civil trial is scheduled to begin in Federal Court in Islip, New York on May 9, 2011 before Federal Judge Sandra Feuerstein. Wal-Mart is being represented by the firm of Brody, OÂ’Connor & OÂ’Connor of Northport, New York.
Attorneys Paul Koenigsberg and Richard Weiss stated that “despite “despite having knowledge of prior incidents in their past Black Friday sales, Wal-Mart has refused to accept responsibility for the horrific injuries sustained by Ms. Walker when she was trampled.” Ms. Walker sustained severe knee injuries from this accident requiring surgeries and reconstruction of her knee and causing her to be disabled from working. Mr. Koenigsberg and Mr. Weiss cited the recent OSHA decision which determined that Wal-Mart failed to furnish its employees with a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm. Koenigsberg & Weiss argue that the protection required to be provided to the Wal-Mart employees should also have been provided to Wal-Mart’s customers.
