After falling behind on car payments and receiving several calls from debt collectors, Ms. Beacham learned that her sister was contacted via Facebook regarding the debt. Consumer rights attorney Billy Howard believed this conduct to be a violation of Ms. BeachamÂ’s rights and filed a debt harassment case in Pinellas County on her behalf. A judge ruled that MarkOne Financial could not contact Beacham or anyone on her page via Facebook, making this the first ruling by a judge specifically stating that creditors cannot use a social networking website to collect a debt.
Mr. Howard has received international press for the Facebook harassment lawsuit and is regularly interviewed for his work in handling debt harassment claims. He has been interviewed numerous times by CBS, NBC, CNN, Fox and 60 Minutes and was featured on two separate Inside Edition specials.
