California Use It or Lose It Vacation Policies Illegal Under State Vacation Pay Law

(EMAILWIRE.COM, October 07, 2010 ) New York, NY – The wage and hour attorneys working with IQOvertime.com are available to review claims from California employees who were denied compensation for unused vacation days. According to state labor laws, earned vacation time cannot be forfeited, making use it or lose it vacation policies illegal in California. Furthermore, California vacation pay law states that employees must be paid for earned but unused vacation time when they leave employment. If you did not receive payment for unused vacation time upon termination or were subjected to a vacation policy which forced you to “use or lose” your PTO days by year’s end, visit http://www.iqovertime.com/california-vacation-pay-law--2-41497.html to find out if you are eligible for financial compensation.

Employers in California are not required to offer vacation days to their employees. However, companies that choose to offer paid time off must adhere to vacation pay laws in California. According to state labor laws, vacation pay is not a gift or gratuity but rather additional wages for services rendered. Although employers can place caps on how much vacation time an employee can accrue without actually using it, California employers cannot take away time their workers have already earned.

For years, courts in California have held that vacation time is a type of deferred compensation, or wages that are paid at a date after which such pay is actually earned. In fact, in August 2010, a judge presiding over a wage and hour case against Lexmark International ruled that once vested, vacation time cannot be forfeited. The judge thereby found that California employers are prohibited from using policies which require workers to give up unused vacation time or deny employees vacation pay upon termination. He awarded more than $8 million in damages to the plaintiffs, 178 current and former employees of Lexmark, who had been subjected to the companyÂ’s decades-long use it or lose it vacation policy.

If you have been subjected to a use it or lose it vacation policy in California or were denied compensation for unused vacation time upon termination or voluntary separation, visit http://www.iqovertime.com/ and fill out the free case review form. The wage and hour lawyers working with IQOvertime.com are providing this initial legal consultation at no cost and are dedicated to protecting the rights of California employees who were subjected to illegal vacation policies at work.
