California DUI Attorney Robert Mortland Explains the Consequences of Driving Under the Influence

(EMAILWIRE.COM, October 01, 2010 ) Oakland, California - Robert Mortland, a criminal and DUI attorney with the Law Office of Robert Mortland, explains the rules and consequences of driving under the influence of alcohol or other substances in California. California DUI laws are very strict and drivers should be aware of the serious impact of a DWI arrest.

If you are driving your car and are stopped by the police, they may arrest you for a DUI if they see any signs which suggest you are intoxicated. This means that if a police officer smells alcohol in the vehicle, he may arrest you for a DUI. If you refuse to submit to any type of blood alcohol testing or a breathalyzer, your California driverÂ’s license will be suspended. In addition, you have a minimal amount of days before you can have a hearing with the DMV.

In California, if you are driving a vehicle and you submit to alcohol testing, you must have a blood alcohol level of less than 0.08. If your blood alcohol level is higher than 0.08, your driverÂ’s license will be disqualified for at least one year. In addition, these rules do not have anything to do with whether you are guilty of a criminal offense. You must submit to blood alcohol testing if you are asked to do so by a police officer. Further, these rules are even more stringent for commercial license holders. The same rules apply, but commercial license holders are only allowed a blood alcohol level of below 0.04.

If you are pulled over for a DWI in California, it is important to get competent counsel that will handle your matter in an effective manner. Robert Mortland is a solo practitioner at The Law Office of Robert Mortland located in the Bay Area of California. Mr. Mortland handles DUIs and other criminal offenses in Oakland, San Jose, San Francisco, Alameda, and Sacramento.

Attorney Robert Mortland is a member of the national attorney network on LawyerCentral.com.
