Mr. Donahue and Mr. Vessup represented the plaintiff in a personal injury lawsuit arising from an accident that occurred while he was working as a lead inspector at the 170th Street Station – Jerome Avenue line – in the Bronx. As the plaintiff walked along temporary flooring on the mezzanine level, a panel gave way and he fell, striking his back and buttocks on a steel support beam. He immediately experienced low back pain with radicular pain into both of his legs.
Although the plaintiff had experienced back problems prior to this incident, the fall he sustained exacerbated his previous conditions and necessitated a lumbar decompression surgery and a lateral interbody lumbar fusion at L4-5. While these treatments have resulted in considerable improvement, the plaintiff is still unable to work and experiences pain with any activity.
