Federal Talcum Powder Lawsuit Litigation Grows, As New Talcum Powder Ovarian Cancer Filings In Six Jurisdictions

Talcum Powder Lawsuit Information: The federal litigation involving talcum powder lawsuits due to ovarian cancer continues to grow, as Southern Med Law notes that at least nine new talcum powder lawsuit cases have been filed in six different federal courts since the beginning of August. All of the talcum powder lawsuit complaints put forth similar allegations regarding the alleged association between Johnson & Johnson’s talc-based powders and ovarian cancer when these products are used on a regular, long-term basis for feminine hygiene purposes.



Talcum Powder Lawsuits Being Filed



According to court documents, the new talcum powder lawsuits include;



Complaint dated August 4th that was filed in the U.S. District Court, Middle District of Georgia, on behalf of a woman who allegedly developed ovarian cancer as a result of using Johnson & Johnson talcum powder products for more than 30 years. (Talcum Powder Lawsuit: Case Nos. 16-00355)



August 4th, two similar lawsuits were filed against the company in the U.S. District Court, Northern District of Georgia.

Two claims, including one alleging wrongful death, were filed in the U.S. District Court, District of Kansas the following day.

Other cases filed during the first week of August include talcum powder lawsuits that are now pending in the U.S. District Court, Southern District of Mississippi

Court records indicate that Johnson & Johnson has been named a defendant in more than 1,200 talcum powder lawsuits nationwide. Many of these cases have been centralized in Missouri Circuit Court in St. Louis. Additional lawsuits are pending in a multicounty litigation now underway in New Jersey’s Atlantic County Superior Court. (In Re: Talc Based Powder Product Litigation – Case No. 300)

Last month, plaintiffs pursuing talc powder ovarian cancer claims petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) to centralize all federally-filed cases involving Johnson & Johnson products in a single U.S. District Court for the purposes of coordinated pretrial proceedings. The July 15th Motion for Transfer noted that at least 11 talcum powder lawsuits were already pending in various federal jurisdictions, all of which were filed on behalf of women who allegedly developed ovarian cancer due to their use of Johnson & Johnson’s Baby Powder and/or Shower-to-Shower talc products for feminine hygiene purposes. If the JPML grants the plaintiffs’ motion, those 11 cases, as well as the nine filed this month, will be transferred to the new proceeding. Any talc powder lawsuits filed in federal courts in the future will also be subject to transfer. (Pending Case No. 70)

Court records indicate that trials of two Missouri talc powder ovarian cancer cases have already concluded with massive verdicts in favor of plaintiffs. The first verdict was rendered in February, when $72 million was awarded to the family of an ovarian cancer victim who died after using Johnson & Johnson talc powders for more than three decades. In April, jurors hearing another talcum powder lawsuit ordered the company to pay $55 million to a South Dakota plaintiff who was diagnosed with ovarian cancer following years of genital talcum powder use.
