(USGovernment-News.Com, May 23, 2014 ) Chicago, IL -- The Oliver Law Group P.C. is representing 14 individuals in fungal meningitis lawsuits who were sickened by allegedly tainted steroid injections manufactured by the New England Compounding Center (NECC). The Firm’s clients currently have fungal meningitis lawsuits pending against NECC in the U.S. District Court, District of Massachusetts, where more than 330 such claims have been consolidated in a multidistrict litigation.

According to a report from LivingstonDaily.com, all of the plaintiffs being represented by The Oliver Law Group received their injections in 2012 at the Michigan Pain Specialists clinic in Glencoe Township, Michigan. The Firm issued a Notice of Intent to File Suit to the clinic on April 3, 2014. The notification gives the parties a six-month window to reach an out-of-court resolution, and allows the plaintiffs to avoid the statute of limitations governing the cases.
Among other things, the plaintiffs being represented by The Oliver Law Group claim that Michigan Pain Specialist ignored a faxed notice it received in September 2012 regarding the NECC epidural steroid recall. They further allege that the clinic created false documentation showing patients were given a brand-name medication, when in actuality they had been treated with the cheaper NECC product, LivingstonDaily.com said.

According to court documents, all of the litigation involving fungal meningitis stems from NECC’s 2012 epidural steroid recall, which was issued after the company determined its methylprednisolone-acetate injections were contaminated with a fungus called exserohilum rostratum. According to the U.S. Centers for Disease Control (CDC), the recalled steroids were linked to more than 700 cases of fungal meningitis throughout the U.S. Michigan was one of the hardest-hit states, recording 264 illnesses, including 19 fatalities.

Court papers filed in the litigation underway in the U.S. District Court, District of Massachusetts indicate that NECC’s bankruptcy created a $100 million compensation fund for alleged victims of the tainted epidural steroids. Attorney Alyson Oliver of The Oliver Law Group told LivingstonDaily.com that the Firm’s fungal meningitis lawsuit clients are waiting to learn how much compensation, if any, they will receive from the fund.
