(USGovernment-News.Com, October 04, 2013 ) RALEIGH, N.C. — Jason and Rachel Degenhard have filed a lawsuit against the U.S. Government as a result of the U.S. Attorney’s Office’s decision to decline prosecuting the child care worker who was supervising their son, 4-month-old Santino, when he suffocated at a Fort Bragg day care center in March 2012.
Surveillance footage shows Rachel Degenhard dropping Santino off at the Pope Child Development Center on the morning of March 9, where he was neglected for almost two hours before being laid face-down on a vinyl mat with a blanket placed under his stomach, causing him to suffocate without notice from the supervising worker.
Because the U.S. Attorney’s Office would not press criminal charges, the Degenhards filed a suit for wrongful death and negligent infliction of emotional distress against the federal government on Monday, September 30. The pair say they are, “heartbroken and disappointed,” at the decision, and felt that they were experiencing a miscarriage of justice.
