A federal labor law known as the Fair Labor Standards Act (FLSA) establishes the minimum wage and overtime standards applicable to the majority of employees in the United States. The FLSA’s minimum wage and overtime pay requirements apply only when an employer-employee relationship exists and therefore do not pertain to independent contractors. It has been alleged that some companies attempt to skirt their obligations under the FLSA by classifying some workers as “independent contractors” despite the fact that these individuals are employees and should be provided FLSA protections. The Department of Labor has provided a fact sheet explaining the meaning of an employment relationship and the significance of that determination. If the company controls or has the right to control the individual’s work performance, that individual is generally considered an employee, rather than an independent contractor. When a worker is an independent contractor, the company will have little to no control over how work is performed.
