(USGovernment-News.Com, July 03, 2013 ) Dallas, TX -- Male workers are not supposed to utilize the ladies room in the Planet Fitness gym at Bay Shore, New York. The rule likely will come with new caveats after the death of a 22-year-old woman who collapsed in a restroom of a New Hampshire-based fitness chain.
Emil Hamlin feel in the restroom of the Bay Shore gym in 2012. The fall was heard by another member of the gym who alerted Planet Fitness workers. However, the worker was a bit hesitant to help and miffed on what to do, according to the documents posted by the Huffington Post: "He said he didn’t know what to do and that he wasn’t allowed to go into the ladies’ bathroom," gym member Stephanie Dick said in a sworn affidavit.
Richard also stated that Higgins was “scared and confused” for a full four and a half minutes before calling 911, according to the video tape provided from the gy. A female Planet Fitness employee eventually entered the room to attempt to help Hamlin. Hamlin was pronounced dead on the scene from “sudden cardiac arrest,” according to the lawsuit.
Hamlin's parents are currently suing the gym as well as the poor employee, due to inaction that led to her death, according to the New York post.
An employee of the Bay Shore Planet Fitness has declined to make any statement, but the Planet Fitness entity itself did make a statement following the request. “At Planet Fitness, the safety of our members is extremely important to us. At this time we have not been served, therefore we are unable to provide further comment,” the statement read.
This is not the first time an unexpected death occurred at a gym. Far from it. There was a case in 2008 wherein a mother sued a cheerleading gym after her daughter sustained fatal injuries while practicing in the facility. A 2004 suit was levied and a Florida gym found liable for a man's death after he suffered a heart attack.
