NFL Wants Injury Suit Dismissed

(USGovernment-News.Com, April 30, 2013 ) Dublin, Ireland -- Lawyers continue to argue in federal court on Tuesday over whether the 4,200 former NFL players are eligible to sue the court over brain damage sustained, or whether the issue ought be decided under the collective bargaining agreement for the players.



It could well turn out to be a high-stakes challenge for both sides of the argument. Players will want the case to be heard in court, while their attorney David Frederick stated on Tuesday the players general wishes. He argued that the league fell short of disclosing information regarding risks to players and “glorified violence at the expense of the players”.



Paul Clement, who is an NFL attorney, called it a “case about workplace safety.” and he stated that suing the league was not the way to go given that the NFL Players Association already possess a collective bargaining agreement.



"There is a certain give-and-take with collective bargaining and you don't have the same rights to sue an employer as somebody in a non-unionized industry would have," Clement told reporters outside the court.



The hearing that has been brought in front of the U.S. District Court Judge Anita Brody currently focuses on the NFL's motion to dismiss the lawsuit entirely. The judge has given no indication of the lean she may have regarding the issue as of present.



"I will rule when I sort these things out for myself," Brody said.



Just outside the court, Mary Ann Easterling, who is the widow of former Atlanta Falcons safety Ray Easterling spoke to the media. Ray was a player who committed suicide in April 2012 after he was diagnosed with degenerative brain disease that his lawyers noted was linked to repetitive and continual concussive blows to the head.
