Sarelson Law Firm Files Overtime Class Action Against FastTrain II Corporation

(USGovernment-News.Com, June 12, 2012 ) Miami, Florida - The Sarelson Law Firm recently filed a class action lawsuit in a Miami district court against FastTrain II Corporation for failing to compensate its employees for working overtime, effectively violating the Fair Labor Standards Act.



Yennifer Martinez, the lead plaintiff, joined the company in December of 2011 as an admissions representative. The company runs FastTrain College, which offers classes in information technology and health sciences. Martinez’s job is to recruit new students and help them enroll in classes. Her supervisors, defendants Alejandro Amor and Chris Amor, told her that she would never work more than 40 hours a week. However, her hours fluctuated between 40 and 70 hours a week, working an average of 50 hours a week in the first five months of her employment. Despite her fluctuating hours, her pay remained constant: $20 an hour. Her pay dropped to $13 an hour after she took an unpaid leave of absence for medical reasons related to her pregnancy. Martinez, along with other FastTrain employees denied overtime wages, is suing for back pay and liquidated damages – approximately $12,000.



“FastTrain II Corporation is in clear violation of both its own policies and the Fair Labor Standards Act,” said Miami litigation attorney Matthew Sarelson. “Ms. Martinez, and several other employees, didn’t receive compensation for hundreds of hours of work performed outside of the standard work week. FastTrain broke the law, and its employees deserve to be rewarded for unpaid overtime.”
