Business bankers, even those paid on a salary basis, are entitled to overtime pay, unless they fall under one of the five major overtime exemptions. Employees who meet an exemption under overtime law are not entitled to collect overtime pay. However, to be truly ineligible for overtime pay under these exemptions, the employee must meet a strict set of criteria. For instance, an employee who is exempt from overtime pay under the administrative exemption must earn a salary of at least $455 per week; exercise discretion and independent judgment in significant matters; and perform office or non-manual work directly related to management or the general business operations of the employer or their customers. Likewise, workers who qualify for the executive exemption must earn a salary of at least $455 per week; have the ability to hire and fire other employees; regularly direct the work of at least two full-time employees; and manage the company, a department or subdivision. Simply holding a managerial job title or being paid on a salary basis is not enough to disqualify an employee from overtime pay. Employees who are placed under an overtime exemption, even though they do not meet the requirements of these exemptions, are said to be misclassified and thereby denied the overtime pay to which they are entitled.
Because it can be difficult for an employee to determine whether they are entitled to overtime pay, Class Action.org is currently offering a free case review to all current and former JP Morgan business bankers to help determine whether they can make a claim for unpaid overtime.
