The Florida tipped minimum wage also increased by 6 cents to $4.29 per hour. The change in the Florida minimum wage was made due to a recent ruling by a circuit court judge.
The ruling was made in a case which claimed that Florida utilized an erroneous formula when calculating yearly adjustments to the Florida minimum wage, instead of using the method required by the state. Allegedly, this resulted resulted in a decrease to the 2010 minimum wage in Florida and would have inhibited future increases by accounting for a small decline in the estimated cost of living for 2009. Leon Circuit Judge Terry Lewis ruled on May 2 that while the Florida minimum wage can be increased due to inflation, it cannot be decreased should the cost of living decline. Approximately 188,000 employers are expected to be affected by the ruling, with those working 40-hour weeks seeing an additional $128 annually.
