Scott Weinstein of Morgan & Morgan, PA Comments on CPSC Chinese Drywall Report

(EMAILWIRE.COM, November 12, 2009 ) Fort Myers, FL - Attorney Scott Weinstein of Morgan & Morgan, PA is one of the attorneys representing homeowners in the Chinese drywall multidistrict litigation (MDL) taking place in New Orleans. In a recent Herald Tribune article entitled “Drywall report offers a theory for symptoms,” Weinstein shared his reaction to the Consumer Product Safety Commission’s (CPSC) federal report on Chinese drywall. The article, written by Aaron Kessler, discusses a theory raised in the report that would explain the health problems that homeowners with Chinese drywall have reported.

The CPSC report states that sulfur compounds, such as those emitted by Chinese drywall, can affect the trigeminal nerve and cause symptoms including coughing, sneezing, eye and throat irritation, headache, and sinus congestion. However, these symptoms can occur at chemical concentrations that are lower than what the government considers a toxic level. Weinstein comments in the article that homeowners would be relieved to hear that the Chinese drywall does not cause any serious long term health effects. However, he adds, if they need to eliminate their exposure to the sulfur compound in order to stop experiencing these health issues, the issue of getting people out of contaminated homes and finding a way to fix them still needs to be addressed.

In order to streamline the discovery process and conserve resources, all Chinese drywall lawsuits pending in federal court have been consolidated in the Eastern District of Louisiana. Judge Eldon E. Fallon, who is presiding over the Chinese drywall multidistrict litigation, is pushing for trials to begin in January 2010. As a member of the PlaintiffsÂ’ Steering Committee, Weinstein has taken a leading role in investigating the problems caused by Chinese drywall and determining how the manufacturers and suppliers of this defective product can be held accountable.
